Litigation Risk Analysis and the Path Integral Formulation of Quantum Mechanics

 

Perhaps the most confusing and non-intuitive formulation of quantum mechanics is the Path Integral Formulation. The work of Weiner and Dirac started the idea behind this formulation but it was Richard Feynman that completed the formulation as a complete paradigm.

The core structure of the path integral formulation starts from the principle of least action of classical mechanics and can be understood under the logic that a particle can take every single available path on its trip from point A to point B - which is allowed under the uncertainty principles of quantum mechanics. The result is that the calculations for the values of the particles take contributions from all available paths.

There is great beauty in this theory and it is a shame that it is hardly heard in public discussions on the way that quantum mechanics operates.

What is very interesting is that in a sense Lawptiize uses a similar technique in calculating value and estimates as part of the litigation risk decision trees. Due to the uncertainties involved every single possible outcome has to be included in the calculations and the purpose behind this is similar to the path integral formulation. We are seeking the right values to evaluate a case but the uncertainties introduced have to allow the lawyer to calculate every single outcome, judge its importance and include it in the calculation for both the perceived value of the case and the risks involved at each point of the litigation.

Naturally, this calculation is done in the background and the lawyer does not need to worry about the technical details. What matters is the end calculations and the understanding of the results from the lawyer that is running the case.
